Terms of Service

These terms govern your use of formdcc.com (the "Site"), operated by the FORM Data Coordinating Center (the "DCC", "we", "us") at Baylor College of Medicine. By logging in to or using the Site, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Site.

Who may use the Site

The Site is for members of the FORM organization on DNAnexus whom the DCC has authorized. You log in with your DNAnexus account, and you are responsible for keeping that account secure and for all activity under it. Do not share your login or let anyone else use the Site as you. Your use of DNAnexus itself is governed by DNAnexus's own terms.

Acceptable use

You agree to use the Site only for FORM research and administration, and not to:

• access, or try to access, data, projects or accounts you are not authorized to use
• probe, scan or test the Site's security, or interfere with its operation
• submit information you know to be false or misleading
• upload malicious software, or material you do not have the right to share
• use the Site in a way that breaks any law or regulation

Data access

Submitting a request through the Site does not by itself grant access to any data. The DCC and the responsible FORM committees decide whether to approve each request. Any data you are given access to is governed by the data use agreements, policies and approvals that apply to it, which you must follow. Nothing in these terms grants you rights to FORM data.

What you submit

You are responsible for the information and documents you submit, and you confirm that you have the right to submit them. You permit the DCC to store, review and use them to process your request, and to share them with the people and services described in our Privacy Policy. Do not upload individual-level participant data or protected health information unless a form specifically asks for it. Submissions are reviewed by the DCC before other users can see any part of them.

Suspension and termination

We may suspend or end your access to the Site at any time, for example if you leave the FORM organization or break these terms. Your obligations under any data use agreement continue after your access ends.

Third-party services

The Site relies on services run by others, including DNAnexus, Wrike and Amazon Web Services. We are not responsible for those services, and their availability can affect the Site's.

Disclaimer

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or secure.

Limitation of liability

To the fullest extent permitted by law, Baylor College of Medicine, the DCC and their staff will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of, or inability to use, the Site.

Changes to these terms

We may update these terms from time to time. We will post the new version on this page and change the effective date above. Continuing to use the Site after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
